These are working defaults from North Dakota practice — not a substitute for the decree. If the judgment says something else, the judgment wins.
North Dakota divides marital property under equitable-distribution principles. Retirement benefits earned during the marriage are commonly allocated by the judgment. As in other ED states, the decree—not a marketing default—sets percentages, coverture, and any separate-property carve-outs.
The decree’s date language controls. We do not invent a valuation date that contradicts the judgment. Public-plan models (NDPERS and TFFR) then apply that date inside their approved QDRO formats.
Signature collection is standard. North Dakota courts can compel cooperation when a party refuses. For NDPERS, there is an additional gate: the system must approve the QDRO before it is signed by the court.
Defined-contribution divisions commonly share market movement after the valuation date through distribution unless the parties lock a dollar figure. NDPERS defined-benefit, defined-contribution, and 457 programs each have their own model orders—copy-paste across product lines fails.
