Missouri divides marital property under § 452.330, RSMo, and related case law. Retirement benefits accumulated during the marriage are typically marital; premarital components and statutory nonmarital categories must be identified. Source-of-funds and transmutation rules can affect accounts that look “separate” on a statement.

Asset valuation / cut-off

Trial date is the usual valuation reference; decree language still controls the order

Missouri authority generally values property as of trial (with dissipation and practicality exceptions). For QDRO/DBO drafting, the division date, coverture window, and any fixed dollar amounts in the judgment or separation agreement are what the administrator will apply. Silent decrees invite fights over post-separation growth.

Who must sign

Both parties normally sign the order packet

Signature collection is standard before submission. Non-cooperation is handled through the court that entered the judgment. Public systems then apply their own DBO/QDRO intake rules to the entered order.

Gains & losses

DC shares usually carry earnings and losses after the division date unless frozen

Unless the judgment awards a frozen dollar amount, defined-contribution divisions commonly share earnings and losses after the valuation or division date through distribution. Defined-benefit coverture formulas (Lynch/Ward lineage) allocate the marital fraction of benefits if, as, and when paid. Premarital DC balances and growth attribution should be addressed expressly.

What makes Missouri QDROs different

Real plan and procedure traps — the reasons generic templates get rejected.

  • MOSERS is divided by a statutory Division of Benefits Order—not an ERISA QDRO. MOSERS instructs parties not to submit a private-plan “QDRO” form.
  • MOSERS alternate-payee awards are generally capped (commonly up to 50% of the annuity accrued during the marriage) and paid only if, as, and when the member receives benefits (shared-interest style).
  • MOSERS DBO benefits typically end at the death of either party—survivor drafting and life insurance offsets matter.
  • PSRS/PEERS benefits are treated under § 169.572 akin to Social Security for division purposes: courts generally may not divide the pension itself; value may still affect the overall marital estate within limits (Woodson; Gismegian).
  • LAGERS benefits are marital in character but heavily protected from execution/attachment, complicating direct-pay orders.
  • Immediate offset versus deferred “if, as, and when” division is a core Missouri drafting choice (Steele; Ward stages of vesting/maturity).
  • Clear loan, premarital balance, and beneficiary language prevents preventable administrator pushback on private plans.
