Free Consultation

We start with a no-obligation phone call. Willie learns about your divorce decree, the retirement plans involved, and what your settlement agreement says about the division. Most consultations take 15–20 minutes.

Document Gathering

Once engaged, we collect the documents we need: your final divorce decree or QDRO-specific court order, the plan summary from your spouse's employer, and any other relevant financial disclosures.

💡 Willie's team handles most of the heavy lifting — we often contact plan administrators directly to get plan-specific requirements.

QDRO Drafting

Willie drafts your Qualified Domestic Relations Order using the plan's requirements and the terms of your case. Plans differ — 401(k), pension, 403(b), CSRS, CalPERS — and each may use different language and procedures.

💡 Turnaround is typically 5–10 business days per plan once documents are received.

Plan Administrator Review

When the plan offers draft review, we submit the proposed QDRO before court entry. Administrator feedback can identify plan-specific issues early and reduce avoidable amendments or delays.

Court Entry, Filing & Final Qualification

Once the draft is ready for filing — and after any available administrator review — we prepare it for court entry. After the judge signs, we send the entered order to the plan administrator for its formal qualification decision.

💡 We provide you with an executed copy for your records. The plan then implements the account split or distribution under its procedures.

Why Draft Review Matters

Some plan administrators will review a proposed QDRO before court entry. When that option is available, we use it to identify plan-specific issues early. Draft review can reduce avoidable amendments and delays, but it does not guarantee final qualification.

How long does the whole process take?

From engagement through court entry and final plan qualification, timing varies by plan, court, and whether draft review is available. A plan's draft review alone may take 2–8 weeks, but some respond sooner or later. We communicate at each stage.

What if there are multiple retirement plans to divide?

Each retirement plan requires its own QDRO. We handle multi-plan divorces regularly — you'll get a flat fee per plan, no per-hour surprises. Many clients have 2–4 plans in a single divorce.

Do I need to be in Connecticut to work with Peacock Law Firm?
