Pension plans typically don’t offer participant loans, but if the plan did allow them, QDROs must take into account unpaid loan balances. Any outstanding balance could reduce the available benefit and affect the alternate payee’s share. Check with the plan administrator to confirm whether loans are even possible under this type of plan.
Since this is a defined benefit pension plan and not a 401(k) or other defined contribution plan, there are no Roth vs. traditional account distinctions or issues regarding tax treatment of split account types. This simplifies the drafting process compared to QDROs for defined contribution plans with Roth features.

This must be carefully worded in the order and adjusted if the participant earns additional service credit post-divorce.
Don’t overlook survivor benefits. If the employee dies before payments start, or after they begin but without electing a survivor annuity, the alternate payee could be left with nothing. The QDRO should require the participant to elect a Qualified Joint and Survivor Annuity with the alternate payee as beneficiary—or the plan may need to assign a separate interest to the alternate payee.
The plan may restrict when an alternate payee can begin receiving monthly payments. Many defined benefit plans require the participant to reach “earliest retirement age” first. The QDRO should clearly define when the alternate payee can begin receiving payments to avoid future conflict or confusion.
It’s important to protect the alternate payee from a participant who might reduce benefits intentionally—such as taking early retirement at a reduced rate. Including a “Molinaro clause” in the QDRO helps preserve the alternate payee’s benefit based on projected full retirement value, regardless of the participant’s retirement decisions.
Once the order is drafted, it typically goes through a preapproval process with the plan administrator. After court approval, the QDRO must be submitted and formally accepted.
