Employee vs. Employer Contributions
When dividing the Retirement Income Security Plan-med Usa, it’s crucial to distinguish between the two types of contributions:
- Employee Contributions: These are usually 100% vested and fully divisible. They’re funded directly from the employee’s paycheck.
- Employer Contributions: These may be subject to a vesting schedule. Only the vested portion can be divided through the QDRO.
If there are partially vested employer contributions, you’ll want your QDRO to clearly state whether the division includes only the vested amounts or accounts for future vesting.
