Employee vs. Employer Contributions
When dividing a 401(k) like the Valley Brook Country Club 401(k) Savings Plan, one of the first questions is whether you’re dividing just the participant’s contributions or also including employer contributions. Most QDROs include everything that’s earned during the marriage—but watch out for the vesting status of employer contributions.
Employer contributions may not be fully vested. That means if the participant hasn’t met certain years of service before the divorce, part of the employer match might not belong to them—and therefore won’t be divisible.
