1. Employee vs. Employer Contributions
Many 401(k) plans include both employee contributions (amounts withheld from the participant’s paycheck) and employer contributions (company match or other incentives). During divorce, both spouses often assume they’re entitled to a 50/50 split—but not all contributions are automatically divisible.
