Employee and Employer Contributions
Most 401(k) plans include both employee salary deferrals and employer contributions. In a divorce, both may be divided via QDRO. However, it’s important to specify which portions are being split. Some couples agree to divide the account as of a certain date, whereas others may divide only what was contributed during the marriage.
If the participant in the White Mountain School Dc Plan received matching or discretionary employer contributions from Guillermo trinchet, those should be addressed in the QDRO. If these employer funds are not yet fully vested, the alternate payee may not be entitled to them.
