Dividing Employee and Employer Contributions
The Foshee Payroll 401(k) Plan likely includes contributions made by both the employee and the employer. These must be addressed separately in the QDRO. Generally, employee contributions are always fully vested and subject to division. Employer contributions, on the other hand, may be subject to a vesting schedule. The QDRO can only divide vested amounts—so confirming the participant’s vesting status through the plan administrator is essential.
