1. Employee and Employer Contributions
Most 401(k) plans include both employee contributions (what the employee has put in from their paycheck) and employer contributions (matching or discretionary contributions from the employer). A QDRO can divide:
- All contributions, both employee and employer
- Only the vested portion of employer contributions
- Only account balances earned during the marriage (known as the marital portion)
