Dividing Traditional vs. Roth 401(k) Accounts
A participant in The Cambridge Health Alliance Partnership Plan may have both pre-tax (traditional) and post-tax (Roth) 401(k) balances. These must be treated separately in the QDRO because they have different tax implications. For example, the recipient of a Roth portion won’t pay taxes upon distribution if the conditions are met. A well-drafted QDRO will accurately spell out how each account type should be divided.
