1. Employee Contributions vs. Employer Match
In Tc Jeep 401(k) Plan QDROs, it’s common to divide only what’s been contributed during the marriage. That includes both the employee’s deferrals and any employer matches. However, some employer contributions may be subject to a vesting schedule, especially in corporate plans like this.
This means part of the matched funds might not be fully “yours” unless you’ve satisfied certain conditions, like a number of years of service. Your QDRO must address:
- Whether unvested amounts will be shared or excluded
- The cut-off date for marital contributions (often the date of separation or divorce)
