Employee and Employer Contributions
401(k) plans typically include both employee and employer contributions. In divorces, it’s common for the QDRO to award the alternate payee a percentage of the plan determined by dates of marriage and separation or divorce. But the employer contributions may be subject to vesting schedules—which means not all of those funds are actually available to divide.
