Employee vs. Employer Contributions
Employee contributions—the money taken out of a paycheck—are always 100% yours. But employer contributions may not be fully vested. That means if your spouse is the employee-participant, some employer match or profit sharing might not be theirs (or yours) depending on their length of employment.
- Always ask for a current and past vesting schedule.
- Make sure the QDRO doesn’t award unvested assets unless agreed by both parties.
