Employee and Employer Contributions
Most 401(k) plans like the Printmpro, Ltd. 401(k) Plan consist of both employee and employer contributions. While employee contributions are typically 100% vested immediately, employer contributions often come with a vesting schedule. If the employee spouse hasn’t been with the employer long enough, some of those employer contributions may not be available for division—either now or potentially ever.
A properly drafted QDRO should specify whether only the vested portion is being divided or if unvested amounts are included, with provisions for what happens if they vest later. This detail matters—especially in longer-term marriages where future vesting could be significant.
