Employee and Employer Contributions
Most 401(k) plans include both employee deferrals and employer contributions. While employee contributions are fully vested immediately, employer contributions often follow a vesting schedule. In the Manual Woodworkers & Weavers, Inc.., Profit Sharing 401(k) Plan, you’ll need to determine whether all employer contributions are fully vested—or if some will be forfeited if the employee leaves the company.
Be aware that only the vested portion of the plan is subject to division in a QDRO. Unvested amounts will not be allocated, so it’s crucial to verify the participant’s current vesting status before drafting the QDRO.
