Employee and Employer Contributions
A 401(k) account typically includes both employee and employer contributions. The QDRO can divide all vested amounts, but contributions made by the employer may follow a vesting schedule. If the participant spouse isn’t fully vested, only the vested portion is divisible by QDRO. This can prevent confusion and disputes if it’s clarified early on.
Make sure your order specifies whether the distribution is based on:
- A specific dollar amount
- A percentage as of a certain date
- The full vested balance as of a certain date
