1. Employee and Employer Contributions
401(k) plans typically include both employee deferrals and employer contributions. In dividing the Hilltop National Bank 401(k) Savings Plan, your QDRO should specify whether the alternate payee is to receive a share of just the employee contributions—or both employee and employer contributions.
Most QDROs divide the marital portion of the account, which could include:
- Employee contributions made during the marriage
- Employer matching or profit-sharing contributions
