Dividing retirement assets in a divorce can be one of the most frustrating and technical parts of the process. If there’s an outstanding loan on the participant’s account, you can’t divide what isn’t there. For instance, if the account has a balance of $100,000 but a $20,000 loan, there’s only $80,000 in true value for division. You’ll need to decide whether the division is based on gross or net account value—and this should be reflected in the QDRO.
Also, a QDRO doesn’t transfer loan responsibility to the alternate payee. The participant remains responsible for repaying any loans taken before the division.
