Employee vs. Employer Contributions
401(k) plans often include both employee deferrals and employer matching or profit-sharing contributions. A QDRO can divide either or both. However, employer contributions are often subject to a vesting schedule.
If part of the employer match is unvested at the time of divorce, that portion may be excluded from division unless the plan allows for post-divorce vesting or the parties choose to divide only the vested balance.
