1. Matching Contributions and Vesting Status
One of the first things to understand is whether the participant spouse is fully vested in the account. Employer contributions in 401(k) plans like the Rps Financial Group, Inc.. 401(k) Savings Plan are not always 100% vested from day one—they often become vested gradually over several years.
If the divorce is happening early in employment, some of those employer contributions may be forfeited. Your QDRO should explicitly define what portion of the account is to be divided—usually the marital (vested) portion based on a specific timeline.
