Employee and Employer Contributions
The Wellframe 401(k) Plan likely includes both employee and employer contributions. The employee’s own contributions are always considered “non-forfeitable” and fully divisible. But the employer contributions might be subject to a vesting schedule. If those employer funds weren’t fully vested as of the couple’s date of separation or divorce, they may be partially or entirely excluded from division. A well-drafted QDRO can account for that.
