Loan Balances
If the participant has an outstanding loan balance at the time the QDRO is processed, the alternate payee’s share is typically reduced by that amount. It’s important to clarify in the QDRO whether the loan is to be subtracted before or after calculating the alternate payee’s share.
Example: If the account shows $100,000 but there’s a $20,000 loan, how the loan is handled matters. If the QDRO fails to address this, the alternate payee might receive less than anticipated.
