Employee and Employer Contributions
Most 401(k) plans, including the Smokin Joes Retirement Plan, involve contributions by both the employee and the employer. During a divorce, a QDRO must clearly define how those contributions will be split. Employer contributions may be subject to a vesting schedule, which means the employee might not be entitled to the full employer match. Be sure your QDRO addresses only the vested portion of employer contributions unless the plan allows otherwise.
