Employer Contributions and Vesting Schedules
Most 401(k) plans, especially in the General Business sector, include employer matching or discretionary contributions. However, those aren’t always fully “vested.” In the Slovene Home for the Aged 401(k) Plan, if one spouse hasn’t met the vesting requirements at the time of the divorce, the unvested portion may be forfeited or unavailable to the alternate payee. It’s critical to include language in the QDRO that specifies how vested versus unvested contributions should be handled.
