Employee vs. Employer Contributions
With 401(k) plans, both the worker (employee) and the company (employer) can put in money. In a divorce, only the vested portion of employer contributions is usually divisible. It’s also important to decide whether to divide just the “marital” portion (typically what was earned during the marriage) or the whole account.
