Employee and Employer Contribution Division
One of the first questions in a QDRO for the Red Dot Corporation 401(k) Plan is whether the order divides the total account balance or only contributions made during the marriage period. Typically, marital community property includes both employee deferrals and employer matches earned during the marriage.
However, employer matches are often subject to vesting. If your spouse is not fully vested at the time of separation or divorce, the non-vested portion could be forfeited. Be sure your QDRO reflects only the vested balance or includes language that automatically adjusts based on final vesting.
