Employee and Employer Contributions
The Radon Medical Imaging, LLC 401(k) Plan may include both employee deposits and employer matching contributions. In a QDRO, it’s critical to clarify which portion is being split. Most orders divide only the marital portion—typically the amount contributed and earned during the marriage.
Employer contributions may be subject to a vesting schedule. If those contributions aren’t fully vested at the time of divorce, an alternate payee (usually the non-employee spouse) may not be entitled to the full employer match. The QDRO should acknowledge this to avoid a fight with the plan administrator down the road.
