Employee and Employer Contributions
Most 401(k) plans, including the Millennial Foods 401(k) Plan, include employee deferrals (the money the participant elects to contribute) and employer contributions. In divorce, it’s critical to:
- Specify whether the division includes both types of contributions
- Clearly state the valuation date (e.g., date of separation, divorce judgment, or another agreed-upon date)
Many times, divorcing spouses agree to split the marital portion—meaning the value accrued during the marriage only—as opposed to the entire balance.
