401(k) Contributions: Who Gets What
The De Novo Works, LLC 401(k) Plan likely includes both employee contributions made by the participant and employer-matching or profit-sharing contributions. When drafting a QDRO, it’s important to divide only the marital portion of the account. This typically means:
- Dividing contributions and earnings during the marriage period only
- Excluding any balance built before marriage or after separation (if agreed or ordered)
The QDRO needs to clearly state whether you’re splitting the account by a percentage (e.g., 50% of the marital portion) or a flat dollar amount. Both options are valid—it depends on what your divorce judgment requires.
