Dividing Employee and Employer Contributions
In a 401(k) like the Mwe 401(k) Plan, an employee contributes pre-tax or Roth dollars to the account. When dividing the plan in a QDRO, it’s important to understand which contributions were made by the employee versus the employer and whether those employer contributions are vested. If they’re not vested at the time of divorce, they may not be available to divide.
