Employee vs. Employer Contributions
The Medex 401(k) Plan likely includes both employee deferrals and employer contributions. When drafting your QDRO, distinguishing between these is crucial—especially if the parties only intend to split employee contributions made during the marriage. If employer matches are involved, check the plan’s vesting schedule to determine what portion is actually divisible.
Often, we recommend specifying that all marital contributions—both employee and vested employer dollars—be divided, while explicitly excluding unvested or post-divorce contributions.
