1. Employer Contributions and Vesting
With 401(k) plans like the Dondelinger Automotive, Inc.. 401(k) Plan, an employee may receive employer matching or profit-sharing contributions. However, these contributions are often subject to a vesting schedule. If a portion of the account isn’t fully vested at the time the marriage ends, that portion may be ineligible for division.
Make sure the QDRO clearly addresses the treatment of unvested funds. Unless the court orders otherwise, only the vested portion of the account is typically divisible.
