Employee and Employer Contributions
With 401(k) plans like the Appcues 401(k) Plan, both the employee and the employer typically contribute to the account. In divorce, a QDRO must carefully specify whether the division applies only to the employee’s contributions or includes the employer’s portion as well.
Most divorcing spouses split the account based on either a flat percentage (e.g. 50%) or a fixed dollar amount as of a specific valuation date (typically the date of divorce or separation).
