Vesting Schedules and Forfeited Amounts
Employer contributions in 401(k) plans like the Melissa Data Corporation 401(k) Profit Sharing Plan and Trust are often subject to vesting schedules. That means your spouse may not be entitled to the full employer-matching portion if you weren’t fully vested at the time of separation or divorce. A properly drafted QDRO must clearly define what portion of the employer contributions, if any, the alternate payee is entitled to and based on what date—the date of marriage, date of separation, or another agreed metric.
