Dividing Employee and Employer Contributions
Most 401(k) plans include two types of funds: employee contributions (money the participant put into the plan) and employer contributions (matching funds, profit-sharing, etc.). In the Keystone Food Products, Inc.. Hourly Employee 401(k) Plan, these contributions must be identified separately in the QDRO. One important question is whether employer contributions are vested—this determines if the non-employee spouse can claim a share.
