Employee vs. Employer Contributions
One of the first questions we’ll ask when drafting a QDRO for the Shurmed Ems 401(k) Plan is how much of the account was earned during the marriage. This includes not only the employee’s own contributions but also the company match.
However, many employer contributions are subject to a vesting schedule. This means if the employee hasn’t worked long enough, part of the employer match may be forfeited. Only vested portions can be divided via QDRO.
