Account Division: Employee and Employer Contributions
The Howell Instruments 401(k) Plan likely includes both employee deferrals (what the employee contributes from their paycheck) and employer contributions. In a divorce, both types can be split—unless some portions aren’t vested. The QDRO must specify exactly how much of the account is going to the alternate payee, either as a flat dollar amount or as a percentage as of a specific date.
