1. Employee and Employer Contributions
Employee contributions are usually 100% vested right away, meaning they can be divided according to the marital portion as soon as the QDRO is in place. Employer contributions, however, often come with a vesting schedule. If the marriage lasted five years, and the employer requires six years for full vesting, part of the employer contributions may not be available to divide.
We recommend confirming the vesting schedule directly with the plan administrator or with a request for plan documentation. This ensures you only divide the vested portion and avoid rejected QDROs.
