Employee vs. Employer Contributions
In a 401(k) plan like the Volk Packaging/paxit 401(k) Plan, employee contributions are always 100% vested. That means everything the employee spouse puts in is eligible for division under a QDRO. On the other hand, employer contributions—such as matching funds—may be subject to a vesting schedule. If the employee spouse hasn’t been with Volk packaging corporation long enough, some of those employer contributions may be forfeited if the employee leaves, limiting what the alternate payee can receive.
