Employee and Employer Contributions
One major issue in many 401(k) plans, including the Verinext Corp.. 401(k) Retirement Plan, is how to divide employee and employer contributions. Generally, contributions made during the marriage are considered marital property. A well-drafted QDRO should clarify whether both employee and employer contributions are included in the division and specify how earnings and losses should be applied from the time of division through the date of distribution.
