If the plan participant (your ex-spouse) hasn’t worked at the company long enough, parts of the employer contributions may be partially or completely unvested—and therefore excluded from division. If there’s an outstanding loan against the 401(k), that must be considered. Do you divide based on the pre-loan balance or subtract the loan from the total?
