1. Employee vs. Employer Contributions
Many assume the 401(k) belongs entirely to the employee—but employer contributions, especially those subject to vesting schedules, can complicate that assumption. The Total Mechanical 401(k) Retirement Plan likely includes both employee deferrals and employer matching contributions. However, only the vested portion is divisible under a QDRO.
For example, if the participant spouse is only 60% vested and the rest is forfeited upon separation, the non-employee spouse can only request division of that 60%. It’s a critical factor we at PeacockQDROs always verify in the drafting process.
