Employee vs. Employer Contributions
In many 401(k) plans—including the Thornton Chevrolet 401(k) Plan—employer matching contributions are subject to vesting schedules. That means your spouse might not be entitled to the full amount shown in the account balance. Only vested portions can usually be divided through a QDRO.
Make sure your QDRO drafting accounts for:
- Fully vested employee contributions (typically 100%)
- Partially or fully vested employer matches
- Unvested portions that may be forfeited if the participant leaves their job
