Different Account Types: Roth vs. Traditional
The plan may include both traditional pre-tax 401(k) contributions and Roth (after-tax) contributions. These need to be divided distinctly in a QDRO. A Roth 401(k) has different tax implications that affect the way the receiving spouse can use the funds and when taxes are due. The QDRO must clearly identify which type of funds are being allocated. Mixing Roth and traditional types without clarification is a common and costly QDRO mistake. More about this atcommon QDRO mistakes.
