Employee vs. Employer Contributions
The Teufel Nursery 401(k) Plan likely includes employee pre-tax contributions and employer match contributions. In divorce, both can be divided, but employer contributions may be subject to a vesting schedule. That means some of the employer money may not belong to the employee yet—and could be excluded from the QDRO if not vested at the time of division.
Before preparing the QDRO, we typically obtain a statement showing the vested vs. unvested portion of the account. If you don’t account for vesting correctly, the alternate payee could end up with less than ordered or require a correction later.
