Employee vs. Employer Contributions
The most common issue in 401(k) QDROs is division of contributions. Employee contributions are always 100% vested. However, employer contributions may be subject to a vesting schedule. If part of the balance hasn’t vested yet, that portion isn’t available for division and could be forfeited later.
In the case of the Teracom Services, LLC 401(k) Plan, if a participant hasn’t completed enough years of service, only a portion of the employer match may be counted in the QDRO. We will adjust the order to account for this vesting status so that the alternate payee receives what they’re entitled to without delays or surprises.
