Vesting of Employer Contributions
One of the most overlooked issues in 401(k) QDROs is vesting. If the participant received matching or employer contributions, those funds may be subject to a vesting schedule. That means only a portion—or perhaps none—of these employer contributions may belong to the participant (or their spouse) at the time of divorce.
The QDRO must only divide the vested portion unless otherwise agreed. We can help calculate vested balances based on the participant’s service years and plan rules.
