Employee and Employer Contributions
Both employees and the plan sponsor—Superior technical ceramics corporation 401(k) plan—may contribute funds to the 401(k). A QDRO must clearly define whether only employee contributions or also employer contributions (including match amounts) are being divided.
Here are some common division methods used in QDROs:
- Percentage Method: The alternate payee receives a specific percentage of the participant’s total account accrued during the marriage.
- Dollar Amount: A set dollar sum as of a specific valuation date.
- Marital Coverture Formula: A proportional formula that only applies to the years of marriage where the employee was contributing to the plan.
