Employee and Employer Contributions
This plan likely includes both employee deferrals and employer profit-sharing contributions. With QDROs for 401(k) plans, we can divide both pre-tax and Roth contributions, as well as employer matches, depending on what is marital property.
It’s important to determine the marital portion of the account. If the participant spouse contributed to the plan before marriage—or after separation—those funds may not be divisible, depending on your state’s marital property laws.
